On the same night Colorado Governor Bill Ritter signs a new law that would ban adults from text messaging and driver, and teens from texting or talking behind the wheelÂ…we hit the streets to see if the new law will work.
"Are you texting and driving?"
That's the question we asked dozens of drivers --who appeared to be texting while stopped at a busy Denver intersection.
Only one driver admitted she was texting a friend, the rest claimed to be doing something else.
"I'm checking email," said one driver.
"I was just about to dial my cell phone," said another.
"Are you texting and driving, I asked a man holding his phone in his hand.
"No, I wouldn't do that," he said.
And that may be the problem with this new law. Just because you're holding your phone a certain ways doesn't necessarily mean your texting.
And that's why Glendale Police Chief Victor Ross admits the law could be hard to enforce. "The first defense for people you stop or in court will be I'm not texting." He says to bust a texting driver you would probably need multiple witnesses.
Still, Ross it's a good law with good intent. And he says if a texting driver causes an accident, this new law will make the penalties tougher.
